Terms of Use

The App is a digital platform designed to help automotive technicians with vehicle diagnostic information and training materials. The App may include diagnostic guides, reference content, troubleshooting workflows, training modules, quizzes, and related resources (collectively, the "Services").

This is important, so please read it carefully. The App is intended solely as an educational and informational resource. It is designed to support, not replace, the knowledge, training, and judgment of qualified automotive technicians.

The App is NOT:

• a substitute for your own professional judgment, training, certification, or experience;
• a substitute for the vehicle manufacturer's official service manuals, technical service bulletins, recall notices, or repair procedures;
• a substitute for hands-on inspection, testing, and diagnosis of the actual vehicle; or
• a guarantee that any diagnosis, recommendation, or training content is accurate, complete, current, or applicable to your specific vehicle, situation, or jurisdiction.

Vehicle systems, software, and recommended procedures change frequently and vary by make, model, year, trim, and region. You are solely responsible for verifying any information provided through the App against current manufacturer documentation and for performing all repairs and diagnoses in accordance with applicable manufacturer procedures, industry standards, safety requirements, and your employer's policies where applicable.

Always follow the manufacturer's official procedures and safety precautions. Never rely solely on the App when making decisions that affect vehicle safety, drivability, or compliance with legal or regulatory requirements.

The App is intended for use by automotive technicians, trainees, and related automotive professionals who are at least 18 years old. By using the App, you represent that you meet this requirement and that you have the qualifications, licenses, or supervision appropriate to perform any automotive work you undertake.

You may need to create an account to use certain features. You agree to:

• Provide accurate and complete information when creating your account.
• Keep your login credentials confidential and secure.
• Notify us promptly of any unauthorized use of your account.
• Be responsible for all activity that occurs under your account.

When using the App, you agree that you will not:

• Use the App for any unlawful purpose or in violation of these Terms.
• Copy, distribute, sell, sublicense, or otherwise share App content without our permission.
• Reverse engineer, decompile, or attempt to extract the source code of the App.
• Upload viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems.
• Use the App to generate or distribute content that is false, misleading, or that misrepresents official manufacturer guidance as your own.
• Remove or alter any proprietary notices, disclaimers, or warnings contained in the App.

Nothing provided by this App constitutes certification, licensure, or endorsement by any manufacturer, regulatory body, or certifying organization unless explicitly stated. You are responsible for confirming whether any App-based training meets requirements imposed by your employer, state licensing boards, ASE, manufacturers, or other authorities.

The App, including its content, design, graphics, diagnostic logic, training materials, trademarks, and underlying software, is owned by the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal professional and training use, subject to these Terms.

The App may reference, link to, or incorporate information from vehicle manufacturers, parts suppliers, or other third parties. We do not control and are not responsible for the accuracy, completeness, or availability of third-party content. Your use of such third-party content is at your own risk and may be subject to additional terms set by those third parties.

THE APP AND ALL CONTENT, DIAGNOSTIC SUGGESTIONS, AND TRAINING MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT ANY DIAGNOSTIC INFORMATION OR TRAINING CONTENT IS CURRENT, COMPLETE, OR APPLICABLE TO YOUR SPECIFIC VEHICLE OR SITUATION.

YOU ACKNOWLEDGE THAT ANY RELIANCE ON INFORMATION PROVIDED BY THE APP IS AT YOUR OWN RISK, AND THAT FINAL RESPONSIBILITY FOR ANY VEHICLE DIAGNOSIS, REPAIR, OR SAFETY DECISION RESTS WITH YOU AND ANY SUPERVISING PROFESSIONAL, IN ACCORDANCE WITH MANUFACTURER PROCEDURES AND APPLICABLE LAW.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY, AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, VEHICLES, OR PROPERTY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, INCLUDING ANY DIAGNOSIS, REPAIR, OR TRAINING DECISION MADE IN RELIANCE ON APP CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT ANY LIABILITY CANNOT BE DISCLAIMED, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR ACCESS TO THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

Some states do not allow certain limitations on liability, so some of the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless the Company, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or any vehicle work performed in reliance on App content.

Certain features of the App require a paid ShopForge Pro subscription. Applicable pricing and billing terms will be presented to you at the time of purchase through the Apple App Store. We may suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. You may stop using the App at any time. You may request deletion of your account by contacting shopforgetraining@gmail.com.

We may update, modify, or discontinue the App or any part of it at any time. We may also update these Terms from time to time. If we make material changes, we will notify you (for example, through the App or by email) and update the "Last Updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles, regardless of your location. Any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in Genesee, New York, and you consent to personal jurisdiction in those courts.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the App and supersede any prior agreements.
